Terms of Use

If you do not agree to these Terms, do not use BeWise. If you act on behalf of a company, you represent that you have authority to bind that company to this agreement.

BeWise is a multi-tenant, on-demand software platform: workspaces (projects) with tools for operations and growth — including AI marketing, creative tests, media libraries, video/image/audio processing, integrations (such as Meta), and billing features.

Features may evolve, enter beta, or be discontinued with reasonable notice when the impact is material.

You are responsible for keeping credentials confidential and for all activity under your account or API keys.

Each project is an isolated workspace. You must ensure only authorized people have access and that use complies with law, contracts with end customers, and third-party platform policies.

We may suspend access if we suspect abuse, security risk, or a breach of these Terms.

You may not use BeWise for: illegal activity; spam or fraud; infringement of intellectual property or third-party privacy; abusive reverse engineering; intentional infrastructure overload; attempts to access other tenants' projects or data; or publishing unlawful, discriminatory content or content that violates connected social network rules.

AI and publishing features should be used with appropriate human oversight — especially for paid campaigns and consumer communications.

You retain rights to content you submit or generate in your project (copy, assets, brand, knowledge bases), granting BeWise a limited license to host, process, transmit, and display that content only as needed to provide the service.

BeWise and its licensors own the platform, trademarks, code, design, and documentation. These Terms do not transfer BeWise intellectual property to you.

AI-generated outputs may depend on your prompts, assets, and project data; you are responsible for reviewing, editing, and publishing those results.

Connections to Meta, payment gateways, cloud providers, and other partners are subject to those third parties' terms. BeWise does not control availability, ads policies, or decisions of external platforms.

Outages, ad rejections, API limits, or third-party changes may affect BeWise features without, by themselves, constituting our breach.

Some features are billed by plan, usage, or product as shown in the platform. Prices, taxes, and billing cycles will be presented at purchase.

Payments are processed by partner gateways. Late or failed payment may result in limitation or suspension of service until resolved.

We work to keep the platform available and secure, but the service is provided “as available.” Maintenance, incidents, and external dependencies may cause temporary interruptions.

Async jobs (such as media conversion or creative generation) may take variable time depending on queue and load.

To the fullest extent permitted by law, BeWise does not guarantee specific business outcomes (conversions, ads ROI, or content performance) or that AI outputs will be error-free.

Except where law forbids it, BeWise's total liability for damages arising from use of the platform is limited to the amounts you paid to BeWise in the twelve (12) months before the event giving rise to the claim.

Nothing in these Terms excludes liability for willful misconduct, gross negligence, or consumer rights that cannot be waived.

You may stop using the platform and request account/project closure through available channels.

We may terminate or restrict access for Terms violations, platform risk, or legal requirements. After termination, your right to use the service ends and data may be deleted per the Privacy Policy.

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the consumer's domicile apply when mandatory; otherwise the parties may agree on a competent forum or follow applicable procedural law.
